If the estate is valued over $150,000 or includes real property titled solely to the decedent, formal probate under the Illinois Probate Act of 1975 will be required to pay debts and distribute assets.
If the estate is valued at under $150,000 and has no real property, a small estate affidavit may allow heirs to collect assets without opening a formal court case.
